Relief for Golden Star Ganesh as High Court gives nod for construction of house in Bandipur

Bengaluru: Sandalwood actor ‘Golden Star’ Ganesh has got a go-ahead from the High Court of Karnataka to construct a house at Kundukere range in Bandipur eco-sensitive zone on Saturday. The actor is constructing a house at Jakkalli village in Kundukere range in 1.24 acre of land.

Appearing for the actor, advocate Sridhar Prabhu referred a Supreme Court order in a 2023 case and said that the forest department has no authority to either cancel or regulate construction. The forest department has already allowed others to build a structure but has prohibited his client from building one, advocate Prabhu informed the court. He submitted before the court that in case the petitioner is at fault, the building would be vacated. Advocate General K Shashikiran Shetty argued that the Supreme Court has allowed only a temporary structure.

Hearing arguments from both the sides, the single bench headed by Justice Krishna S Dikshit observed that if the forest department has prohibited the petitioner to construct, how did it allow for others. Prima facie, it appears to be a new permission. Hence, the petitioner could go ahead with the construction, the court said.

The Bench directed the petitioner to submit documents sought by the ESZ committee through advocate general and also adjourned the hearing on September 12.

It may be recalled here that recently, High court had turned down the actor’s appeal seeking to vacate a stay order served on him by the forest department and eco-sensitive zone monitoring committee of Bandipur Tiger Reserve. The Eco-sensitive Zone had served a notice to the actor on August 14 for allegedly violating ESZ norms in construction.
