RTI activist complains to Governor against Lokayukta officers of Mysuru, Bengaluru

Mysuru: RTI activist N Gangaraj has urged Governor Thaawarchand Gehlot to take appropriate action against Lokayukta officials who have not acted in accordance with law and are attempting to neutralise MUDA scam committed by the present Chief Minister Siddaramaiah, Urban Development Minister Byrati Suresh and Bagali Marathi OSD for Urban Development Minister, Dr Natesh D B and G T Dinesh Kumar, Ex- MUDA Commissioners and Others.

1. That as a responsible citizen I have filed several complaints before Mysore Lokayukta with documents in support of the allegations made therein. Besides, several other persons have also filed complaint with supporting documents. Based on the aforesaid complaints, A Ravikumar inspector, Lokayukta has investigated the matter. On the basis of the investigation conducted by him he has submitted a thousand page report along with all relevant documents and materials to his higher authority. Malteesh S K DySP, Lokayukta Police Mysore division, who has in turn forwarded the said report to Bengaluru Lokayukta through V J Sajeeth. IPS, (then SP of Lokayukta Mysore) to get necessary orders/permission/Search warrant from Karnataka Lokayukta to register case and proceed further on June 1st week.

2. It is learnt that the report was submitted to Lokayukta Office at Bengaluru seeking necessary search warrant as required under the section 10 of Karnataka Lokayukta Act, 1984 (hereinafter called as “Act, 1984” for brevity) and for further action to proceed with the case. That after considering the facts Lokayukta issued search warrant after 28 days on requesting several times from V J Sajeeth, for A Ravikumar, Inspector Lokayukta, Mysuru with instructions to ready to take action with prior permission but the warrant was not executed till 03-07-2024. The same was issued in fact after a delay of around 28 days. This delay of 28 days was intentionally caused by the Karnataka Lokayukta to facilitate the wrong doers to tamper and destroy or remove incriminating evidence and documents. On 28.06.2024 Venkatachalapathy IAS and some officers came to Mysore and took around 140 files of illegal 50:50 ratio. This information were published in major newspapers on next day. The subsequent issuance of the Search Warrant was done only as a formality to cover the illegal actions committed by Lokayukta itself. Further, though the search warrant was issued, it was accompanied with instructions to withhold the search till instructions are received from the Karnataka Lokayukta.
3. On 04-07-2024 the V J Sajeeth IPS was transferred and relieved on 04/07/2024 and on 05/07/2024 Karnataka Lokayukta Bengaluru has withdrawn the search warrant. During interregnum, DYSP Malteesh S K negotiated with then Ex Commissioner, MUDA, Mysore G T Dinesh Kumar, Ex- Commissioner MUDA, Dr Natesh D B, Urban Development Minister Byrathi Suresh, Bagali Maruthi, OSD for Urban Development Minister who has taken files from the office of MUDA On 01.07.2024 to prevent prosecution against the Chief Minister Siddaramaiah and others who are all involved in the similar illegal acts in getting sites.

3. It is further submitted that to suppress the illegal acts of the officials and the Chief Minsiter and Urban development Minister, the Higher Officials have suppressed the report submitted by A Ravikumar Inspector Lokayukta Mysore. That DYSP Malteesh S K, has Negotiated the deal for bribe of Rs 8 crores with Lokayukta Bengaluru Lokayukta officer. DYSP Malteesh is hand in glove with the scam to avoid registration of case and further Lokayukta totally failed to safe guard interest of public and public authority. Malteesh, DYSP, Mysore Lokayukta himself told the senior officer of Mysore Lokayukta that 8 crores of money was given to the Karnataka Lokayukta by MUDA officials and others to cover up the above scam, which means that this official knows the full details of this illegal payment and it means that malteesh has a share in it. Mr. Malteesh, DYSP, of Mysore has done illegal benami property. Fresh example of this is Survey: 196/2, Karakanahalli Village, Ilawala Hobli, Mysore. Farm house is being constructed here in benami name. The information is attached.

“For aforesaid reasons, the following questions remains unanswered”

i. Why Lokayukta has not initiated Legal Action based on the report submitted by Mysore Lokayukta.

ii. Why Lokayukta has not directed its officials at Mysore to conduct search immediately as soon as search warrant was issued and why it was instructed to withhold search for Nearly 30 days.

Why Lokayukta has waited till the State Government appointed IAS officers, committee to conduct enquiry of the issue.

The act of Lokayukta itself shows that agency failed to exercise its jurisdiction and that it is working in favour of State Government to protect the Chief Minister and Urban development Minister from their illegal acts.

4. Byrati Suresh Minister of Urban Development Department wanted another corrupt official Bagali Maruti who was selected in Kalyana Karnataka Group and got promotion in the same group and without serving there he served in strategic places like MUDA, BDA, UD and now Byrati Suresh, as OSD of Minister of Urban Development Department. Bagali Maruti was retained to recover millions of rupees for files coming from urban development authorities of Karnataka State, such as land use change, denotfication cases and transfer of department officials and other works.

Byrati Suresh and Bagali Maruti are directly responsible for the current problem of the Urban Development Authority. It is known that 8 crores of money was arranged under his leadership for the above case, and a report has to be obtained about his illegal status and the files pending in the Urban Development Department for Many years. Bagali Maruti has illegal assets worth crores of rupees. Even now there are several land use change files and other files in Urban Development Department around 2019 For money from the owner of the private estate for money to dispose of these due since The files are kept undisposed by the demand and gets millions of rupees for every transfer of the officers of the department.

Byrati Suresh and Bagali Maruti are directly responsible for the current problem of Mysore Urban Development Authority, for the above case. It is known that 8 crores of money was arranged under his leadership, and a request has been made to get a report about his illegal assets and the files pending in the Urban Development Department for many years.

5. That I had been to office of Lokayukta on 07-10-2024 with an application under the provisions of RTI Act seeking details of above facts but the tappal section of Bengaluru Lokayukta office refused to receive application and ask me to wait till 3.30 pm. Without any alternative I have sent my application through registered post. This clearly shows that Lokayukta itself is involved and is hand in glove with the State Government to prevent further investigation with regard to illegal allotment of sites and further under scheme of 50:50 allotment of site even for the land owners who have already received award amount and in some cases award amount deposited before the court.

Hence, it is requested to,

(i) take action against Lokayukta, Bengaluru and Mysore Lokayukta and its officials who have committed dereliction of duty by engaging independent investigating agency which is not under the control of State Government which is like CBI,

ii. Issue necessary directions to concerned department to safeguard the interest of officials who have given information,

iii. Issue necessary directions for immediate suspension to DYSP Malteesh, Lokayukta, Mysore to avoid destruction of relevant documentary evidence by him, to meet ends of justice And Malteesh S K, DySP, Lokayukta Mysore request to order investigation of illegal remains.

Maltesh DySP, Lokayukta in collusion with Muda officials and Karnataka government has not maintained the confidentiality of the department, misused power, formed an illegal group, abetted corruption, cooperated with the corrupt for the purpose of making money, dereliction of duty and Karnataka Lokayukta has cooperated. Therefore, they are requested to recommend to the central government to conduct an investigation by CBI or an investigative agency under the central government.

Special appeal

Malateesh S K, DYSP Lokayukta mysore in collusion with Muda officials and Karnataka government has not maintained the confidentiality of the department, misused power, formed an illegal group, abetted corruption, cooperated with the corrupt for the purpose of making money, dereliction of duty and Karnataka Lokayukta has cooperated. Therefore, they are requested to recommend to the central government to conduct an investigation by CBI or an investigative agency under the Central Government.
