Disqualified MLAs in Karnataka can contest elections: SC

New Delhi: Ending speculations over the contest of 17 disqualified MLAs in the by- elections scheduled to be held in Karnataka on December 5, Supreme Court has ruled in favour of them.

The three- judge bench led by Justice N V Ramana has ruled that “The disqualified MLAs can contest the elections, but are restricted from holding any office as minister till the elections. It was wrong on the part of the speaker of Legislative Assembly to bar them from contesting the elections”.

However, the same bench has upheld the decision of the speaker to disqualify them in the interest of democracy.

The apex court has also taken exception to the move of the MLAs to file a petition in Supreme Court, without filing the same plea at Karnataka High Court.
